Car Insurance When the Driver Is Different from the Owner

A car can be registered and insured in one person's name but driven by someone else. This is common when a family member, spouse, friend or personal driver uses the car. In such cases, the car insurance does not automatically become invalid just because the person driving is different from the owner. However, the driver must meet the applicable legal and policy conditions to ensure valid coverage.Read more

Is Car Insurance Linked to the Vehicle or the Owner?

As per IRDAI, car insurance is linked directly to the vehicle rather than the owner. So, if you lend your car to a friend or relative and they meet with an unfortunate accident, your insurance policy will help cover the repair costs, provided the other person were driving with your consent, also known as permissive use in motor insurance. But the type of coverage available depends on the nature of your policy and the specific situation.

How Does the Type of Car Insurance Affect Coverage for Another Driver?

The type of car insurance determines what is covered when someone other than the owner drives the insured car. Have a look:

    1. Third-Party Liability Coverage

Under the Indian Motor Vehicles Act, 1988, it is legally compulsory for every vehicle owner on public roads to have at least third-party insurance.

      • The Scenario: Your cousin borrows your car and accidentally hits another vehicle or injures a pedestrian.
      • The Outcome: Your insurance company will handle the legal and financial liabilities for the damages, injuries, or death caused to the third party. You do not need to pre-declare occasional drivers to your insurer for third-party protection to apply.
    2. Comprehensive Coverage

If you have comprehensive car insurance, it will cover damages sustained by your own vehicle along with third party liabilities.

      • The Scenario: A friend borrows your SUV and accidentally dents it against a pillar while parking.
      • The Outcome: Your insurer will cover the repair costs at a network or non-network garage. However, because the policy is in your name, you (the registered owner) must file the claim. The insurer will pay the garage directly or reimburse your bank account, never the driver's.

Does the Driver Need to Be Named in the Car Insurance Policy?

No, a driver does not generally need to be explicitly named in car insurance for the car to remain covered. However, the following conditions should be met when someone other than the owner drives the car:

    1. Valid Driving Licence

The driver should hold a valid driving licence for the type of vehicle being driven. Driving without a valid licence can affect the insurer's liability under the policy.

    2. Owner's Permission

The car should be driven with the owner's permission. Unauthorised use can create problems during a claim.

    3. Permitted Use of the Car

The vehicle should be used for the purpose stated in the policy. For example, a private car should not be used for an unauthorised commercial purpose.

    4. Compliance With Policy Conditions

The driver must comply with the applicable terms, conditions and exclusions of the policy. A policy does not provide unconditional protection simply because it is active.

When Can Another Driver Affect Your Car Insurance Claim?

Just because someone else was driving your car does not mean the insurer will reject your claim. What matters is whether the driver was using the car within the above-mentioned rules of your policy.

For instance, if your friend was driving without a valid licence, a family member was using your private car for delivery work, or you bought a second-hand car but did not transfer the insurance, all these situations are where car insurance companies can deny a claim.

So, having a different driver behind the wheel is not the problem. The real issue is whether the driver and the way the car was driven comply with the policy terms & conditions.

Does CPA Cover Apply When Someone Else Drives?

The Compulsory Personal Accident (CPA) cover is for the owner-driver (the registered vehicle owner and the insured person), not for every person who drives the insured car. So, if you own and insure the car in your name, your owner-driver PA cover is meant for you when you are driving the car. It does not automatically extend to them. If you have a hired driver, a separate 'Paid Driver' add-on cover helps protect your legal liability towards the driver, as per policy terms and law.

Different Drivers, Different Situations: How Car Insurance Works

Here are some situations car owners may face when someone other than them drives the car:

    • If your friend takes your car for a short trip: Your insurance can generally continue to apply if you gave your friend permission to drive and they have a valid driving licence.
    • If your spouse or child drives the car regularly: The insurance does not become invalid just because they are not the registered owner. However, if someone else uses the car regularly, it is better to check with your insurer if any update is needed.
    • If you have a personal driver: Your driver can use the car for the purpose it is insured for. However, your owner's personal accident cover does not automatically cover the driver. You may need separate protection for a paid driver.
    • If a learner driver takes the car: The learner must follow all the rules applicable to a learner's licence while driving. If these rules are not followed, it can create problems during a claim.
    • If someone uses your private car for delivery work: This can cause an issue if your policy covers the car only for private use. Using it for delivery or other unauthorised commercial work can affect the claim.
    • If you buy a second-hand car but do not transfer the insurance: Getting the RC transferred to your name is not enough. The insurance policy also needs to be transferred as required. Otherwise, you may face problems when making a claim.

What Happens if Someone Else Regularly Drives the Car?

Occasional use by another person is different from having someone else use the car regularly. For example:

    • A parent owns the car but their child uses it every day.
    • One spouse owns the car while the other uses it regularly.
    • A personal driver uses the car frequently.
    • An employee regularly drives a privately owned car.

In such cases, it is important to check the terms & conditions of your car insurance provider and disclose the necessary information when required. Your insurer may have specific requirements depending on the policy and the nature of the car's use. The safest approach is to ensure that your policy information remains accurate at all times.

What Should You Check Before Letting Someone Else Drive Your Car?

Before handing over your car to another person, check these points:

    1. Check the Driver's Licence: Make sure the person has a valid licence for the vehicle.
    2. Give Permission: Ensure the person is authorised to use the car.
    3. Check the Policy: Review the policy's terms, exclusions and permitted use.
    4. Avoid Unauthorised Use: Do not allow the car to be used for a purpose not covered by the policy.
    5. Check Regular Use: If another person regularly drives the car, verify whether the insurer requires any additional information or changes.
    6. Carry Valid Documents: The driver should have access to the required vehicle and insurance documents.

Is the Car Owner Legally Responsible if Someone Else is Driving?

If someone else is driving your car, you do not automatically become legally responsible for everything the driver does. However, as the registered car owner, you may still receive notices or face legal proceedings in some accident-related cases. If the driver was using the car without a valid licence or against the car insurance policy terms, it can also create financial and legal complications for you. So, always check that the person driving your car is properly licensed and using the car for its allowed purpose as per your policy.

    FAQs

    • Can the owner claim car insurance if they were not driving at the time of the accident?

Yes, the owner may be able to claim under the applicable section of the policy even if another person was driving, provided the policy conditions and other claim requirements are met.
    • Does car insurance become more expensive if another person drives the car?

Not necessarily. The premium is primarily determined by factors such as the car's model, location, IDV, coverage and selected add-ons. However, any insurer-specific requirements relating to the driver should be checked.
    • Can a person who is not the registered owner file a car insurance claim?

The person driving the car may report an incident or assist with the claim process, but the policyholder or registered owner may need to provide the required documents and complete the claim formalities, depending on the insurer's process.
    • Does changing the regular driver require a new car insurance policy?

No, changing the regular driver does not generally mean that the entire policy needs to be replaced. However, you should inform the insurer if the change affects information or conditions relevant to the policy.
    • Can the owner-driver and registered car owner be different?

The terms are not interchangeable. An owner-driver is specifically defined under motor insurance regulations and refers to the eligible registered owner who is also the insured and holds an effective driving licence.
    • Can I exclude certain drivers from my car insurance?

Some insurers may allow you to exclude a specific person or persons from the car insurance coverage. It is best to contact the insurer to know about such details.
    • If someone else drives my car and has an accident, are they liable to pay for the damages?

Legally, if you gave the person permission to drive, your car insurance policy is responsible for covering the damages caused by the accident.
